The Panel wanted to understand whether there were strongly held cultural assumptions which influenced the way consumers would respond to drinks in cans. In a survey by YouGov [1] of over 2000 adults, 80% of those surveyed believed that a 500ml 9% abv can was designed for the contents to be consumed by one person in one sitting. The data was similar for a 440ml 4% ABV can. The data also showed only 2% of people thought these cans were easy to reseal once opened. The Panel shared this view. Consumers would not share the contents of a can, or reseal it saving it for another drinking occasion, the contents would instead be consumed by one person in one drinking occasion.Young's main brands are Young's Bitter (commonly known as Ordinary) renamed Young's London Original in 2019, a 3.7% abv bitter made with Red Tractor accredited Maris Otter and crystal malt and Fuggle and Golding hops; and Young's Special renamed Young's London Special in 2019, a 4.5% abv version of the Ordinary. The main popular super strength lagers at 9%, all brewed by major drinks companies, include Tennent's Super, Carlsberg Special Brew, Skol Super and Kestrel Super. Waggle Dance, a 5.0% abv pale ale made with the addition of South American honey, named after the waggle dance a bee performs to alert the hive of a source of nectar. The brand was originally owned and brewed by Sunderland-based brewer, Vaux; it was bought by Young's Brewery when the Vaux brewery was closed in 1999, and by 2008, the brand was transferred to Charles Wells beer.[4] The FWD has warned that other high strength 500ml products, which are not subject to the ban, may be illegal because no UK duty has been paid on them.

Wholesalers have reported falling sales of superstrength lagers in recent years as a proliferation of non-duty-paid brands floods the market, including foreign imports and UK-produced lager intended for export which is diverted onto the domestic market, according to the FWD. The Panel also noted the ‘share’ message only featured on the can of Super Premium despite most of the other cans in the range being the same size; the Panel questioned this. They decided that to differentiate Kestrel Super Premium from the others in this way could also be because the producer was conscious of the product’s strength, and therefore units and the message therefore acted as a warning to consumers. This would support the view that the combination of the size of the can and high strength of the product would encourage immoderate consumption. FWD chief executive James Bielby said: “The side effect of taking mainstream products out of the market is that it creates an opportunity for the illicit trade.
